The Zamfara State chapter of the African Democratic Congress (ADC) has maintained that the Federal High Court judgment delivered on April 29, 2026, remains legally binding despite ongoing legal proceedings.
In a statement released in Gusau, the party’s Publicity Secretary, Abdulkareem Umar, rejected claims challenging both the court ruling and the legitimacy of the party’s leadership in the state.
According to the ADC, Senator David Mark has appealed the judgment and sought a stay of execution. However, the party noted that the request for a stay was not granted, while the Court of Appeal has already scheduled a hearing for the appeal.
“The Federal High Court judgment remains valid, subsisting and binding on all parties unless and until it is set aside by a competent appellate court. No individual, group or political interest can lawfully vacate, nullify or disregard the judgment except through the legally recognised appeal process. Court orders must be obeyed while they remain in force.”
The party also clarified that filing an appeal does not automatically suspend the enforcement of a court judgment. It cautioned that initiating multiple appeals over the same matter could amount to an abuse of court process.
Addressing the leadership issue, the ADC said its current State Executive Committee emerged from a duly conducted state congress held in accordance with the party’s constitution. It added that the executive, led by Alhaji Kabiru Garba Gusau, has a tenure that runs until April 12, 2031.
