British Airways Faces Lawsuit Over Missing Luggage

The Federal High Court of Nigeria has fixed July 2 for the continuation of hearing in a lawsuit filed against British Airways
over the alleged disappearance of a passenger’s carry-on luggage.

The case was instituted by Amechi Michael, who is seeking redress after claiming that his luggage went missing during a delayed boarding process involving the airline.

At the resumed hearing of the matter, the plaintiff was cross-examined by defence counsel, Mr John Godwin, where he explained the steps he took after discovering that the luggage could not be recovered.

According to Michael, he initially lodged a complaint with the airline’s customer care department before the matter was referred to the UK-based Centre for Effective Dispute Resolution (CEDR) for arbitration.

He told the court that although the arbitrator ruled in his favour concerning the delayed flight, the issue surrounding the alleged missing carry-on luggage was not addressed in the decision.

The plaintiff further stated that he was dissatisfied with the arbitral award and subsequently rejected it before approaching the Federal High Court in Abuja for legal intervention.

Michael argued that the airline owed him a duty of care after a member of the cabin crew allegedly requested that he hand over the carry-on luggage for safekeeping during the boarding process.

He also accused the airline’s staff of negligence, insisting that the missing bag should have been returned to him.

Counsel to the plaintiff, Barrister Abiola Olaitan, later informed the court of her intention to close her client’s case after the cross-examination.

Presiding judge, Justice Obiora Egwuatu, subsequently adjourned the matter until July 2 for continuation of trial and defence proceedings.

The suit, marked FHC/ABJ/CS/1293/2025, centres on the plaintiff’s demand for the recovery of the luggage allegedly lost while in the custody of the airline.
